The reform aims to ensure the quality and reliability of Spanish Patents and update the current regulations in force since 1986.\u00a0<\/p>\n<p>This major reform intend to adapt the Spanish legal framework in patents field to the reality of Spain of XXI century.<\/p>\n<p>We are going to discuss and briefly analyze which modalities are affected by the reform and how this change in the Spanish patents law affects the situation.\u00a0<\/p>\n<h2><b>Draft bill of new Patent Law: Patents<\/b><b><\/b><\/h2>\n<ul>\n<li>The draft bill of patent law simplifies the granting process and <strong>requires to pass a preliminary examination<\/strong>, through which is going to disappear the granting of weak patents. Thereby, patents that are finally granted shall demonstrate that they are new, involve an inventive step and have industrial application.<\/li>\n<li>The<strong> protection of innovation is encouraged by SMEs and entrepreneurs<\/strong> with the decrease of official rates\u2019 cost.\u00a0<\/li>\n<\/ul>\n<h2><b>Draft bill of new Patent Law<\/b><b>: Utility Models<\/b><\/h2>\n<ul>\n<li>The law also strengthens <a href=\"http:\/\/www.protectia.eu\/en\/utility-models\/utility-models-essential-notions-and-countries-in-which-can-be-registered\/\" target=\"_blank\" rel=\"noopener noreferrer\">utility models<\/a>, since <strong>international novelty<\/strong> will be required.<\/li>\n<li>Its scope of application is extended to <strong>chemicals<\/strong>.<br \/><b><!--more--><\/b><\/li>\n<li>Besides, its solidity is ensured by requiring the Report on the State of the Art.
