After obtaining the registration of \u201cGoogle Glass\u201d as a trademark, a few months ago the company files an application for the world \u201cGlass\u201d.<a href=\"https:\/\/www.protectia.eu\/wp-content\/uploads\/2023\/05\/Google_Glass_-scaled.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-8931\" alt=\"Google_Glass_\" src=\"https:\/\/www.protectia.eu\/wp-content\/uploads\/2023\/05\/Google_Glass_-scaled.jpg\" width=\"584\" height=\"327\" \/><\/a><\/p>\n<p>As it had to be expected, the Mountain View group is having some trouble to obtain the registration of the word \u201cGlass\u201d as a trademark and facing quite a lot of criticisms.<\/p>\n<p>In fact, the <a href=\"http:\/\/www.uspto.gov\/\">USPTO<\/a> <em>(United States Patent and Trademark Office)<\/em> has objected to the application declaring that <strong>\u201cglass\u201d is merely descriptive<\/strong> (therefore lacking one of the main requirements for a word to be registered as a trademark) <strong>and also very similar to other software products, element that could induce consumers to confusion.<!--more--><\/strong><\/p>\n<p>In response to the USPTO, Google\u2019s lawyers sent a 1.928 pages document in defense of the application. They disagreed on the \u201cdescriptive\u201d point, noting in their letter that \u201cthe frame and display components of the Glass device do not consist of glass at all,\u201d but are made from titanium and plastic. The attorneys also said the word \u201cglass\u201d alone does not \u201cinform potential consumers as to the nature, function or use\u201d of the product Google is selling. So the defense is centred in two points:<\/p>\n<ul>\n<li><span style=\"line-height: 15px;\">&#8220;Google Glass&#8221; are not made of glass, but titanium and plastic<\/span><\/li>\n<li>The media coverage has already been so big that is not possible to genereate confusion.<\/li>\n<\/ul>\n<p>Without entering deeper into the legal question, we could say that Google tried a \u201csmart\u201d marketing move: in fact, <em><strong>commercializing the product under the name \u201dGlass\u201d instead of \u201cGoogle Glass\u201d would be useful \u00a0regarding \u00a0marketing and advertising.<\/strong><\/em><\/p>\n<p>This is certainly not the first time that a big company is trying to use is huge power in the market.
