{"id":7004,"date":"2014-03-05T13:02:30","date_gmt":"2014-03-05T13:02:30","guid":{"rendered":"https:\/\/www.protectia.eu\/the-first-software-patent\/"},"modified":"2026-02-09T12:18:24","modified_gmt":"2026-02-09T11:18:24","slug":"the-first-software-patent","status":"publish","type":"post","link":"https:\/\/www.protectia.eu\/en\/the-first-software-patent\/","title":{"rendered":"The first software patent"},"content":{"rendered":"<p>The patent system applied to the software industry has always generated many debates in the latest years, about whether or not a software should be patentable.<\/p>\n<p><iframe loading=\"lazy\" title=\"The First Software Patent | INVENTORS | PBS Digital Studios\" width=\"800\" height=\"450\" src=\"https:\/\/www.youtube.com\/embed\/yKdqJGgpcgg?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>For our <em>\u201cPatents world\u201d<\/em> section, this week we would like to offer an interesting and enjoyable video documentary developed by filmmaker and photographer David Friedman for PBS, presenting the story of <strong>Martin Goetz<\/strong>, the man who<em><strong> got the very first patent in 1968, granted by the USPTO.<\/strong><\/em><span style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">All began when Martin Goetz with his small software company, <\/span><em style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Applied Data research<\/em><span style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">, pioneer of the software products industry, <\/span><strong style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">applied for a patent in 1965 for a machine process for sorting data on a general-purpose computer.<\/strong><\/p>\n<p>It is interesting to realize that this first software patent, back in the 60ies, was a powerful tool that enabled a small company to compete against a big one, such as IBM.<\/p>\n<p>There is a lot of confusion between ideas, mathematics, software and inventions. As the same Martin Goetz affirm on an extremely enlightened article, <em>\u201cthose for or against software patents have been debating the wrong question.[\u2026] They&#8217;ve been asking: is software patentable? I believe the debate would have been very different if it focused on the question: &#8220;Is an invention that is patentable in hardware, equally patentable if implemented in software?&#8221;<\/em><\/p>\n<p>We are not going to enter deeper into the \u201cdispute\u201d, only we would like to remark the competitiveness of the software industry.
