{"id":6956,"date":"2013-12-04T11:54:41","date_gmt":"2013-12-04T11:54:41","guid":{"rendered":"https:\/\/www.protectia.eu\/fundamental-features-pct-process\/"},"modified":"2013-12-04T11:54:41","modified_gmt":"2013-12-04T11:54:41","slug":"fundamental-features-pct-process","status":"publish","type":"post","link":"https:\/\/www.protectia.eu\/en\/fundamental-features-pct-process\/","title":{"rendered":"Fundamental features of PCT process"},"content":{"rendered":"<p>This week, for the \u201c<em>Patents world<\/em>\u201d section we propose you a very interesting video, developed by the <a href=\"http:\/\/www.wipo.int\/portal\/en\/index.html\">WIPO<\/a> (World Intellectual Property Organization), which can be very helpful to better understand or simply have an approach to the PCT process.<em><strong><\/strong><\/em><\/p>\n<p>First of all, before to watch the video, let\u2019s remind that <a href=\"http:\/\/www.protectia.eu\/blog\/en\/patents\/pct-patent\/\">PCT (Patent Cooperation Treaty)<\/a> is not a procedure for granting patents and does not replace national granting proceedings, but<strong> is a unified procedure for filing patent applications before its granting<\/strong>, which replace a big part of the process country by country, lowering costs and extending deadlines.<\/p>\n<p><iframe loading=\"lazy\" src=\"\/\/www.youtube.com\/embed\/8dVuT8q_mT4?list=SPsm_LOEppJawGEathiEBhgNEHmuHgZk9C\" height=\"360\" width=\"640\" allowfullscreen=\"\" frameborder=\"0\"><\/iframe><\/p>\n<p><!--more--><\/p>\n<p>Basically, the video explains a few basic elements:<\/p>\n<p>\u2022 First,<em><strong> obtaining an International Filing Date (IFD)<\/strong><\/em><strong> <\/strong>on the day when the international application is submitted.\u00a0There are several requirements to do that: having a \u201cpetition\u201d (it has to be clear to the receiving office that an International application is filed, and not for instance a National Patent Application), designating all the contracting States, naming at least one applicant in the International application, etc.<br \/> \u2022 <strong>Who can file <\/strong>an application under the PCT? Any natural person or legal entity (Ex: company). To note, at least one of the applicants needs to be a national or resident of a PCT contract State.<br \/> \u2022<strong> Where to file<\/strong> the international application under the PCT?
