Community trademark registration

The Community Trademark is a trademark registered in OHIM (Office for Harmonization in the Internal Market) which is valid across the European Union territory in accordance with the provisions set forth in Community Trademark Regulations. Located in Alicante, Spain, OHIM is the European Agency responsible for the registrations of trademarks, drawings and models valid in the 28 Member States of the EU.

The Community Trademark is therefore valid throughout the European Union and limiting the geographical scope of protection to certain member states is not possible. It is thus a single application which encompasses the 28 member states: Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Holland, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and United Kingdom.

 The essential characteristics for filing a Community Trademark include:

  • OHIM can only refuse an application due to an opposition by third parties and to the prohibition provisions established by Law. OHIM cannot act on its own account in case of similarities with other trademarks, even in the situation concerning identical trademarks.
  • In the event of litigation (oppositions), the losing party will take on the expenses of the procedure (the corresponding ones according to the rules).
  • In case of refusal due to problems in one of the member countries, the registration will be denied in its entirety.
  • The possibility to convert a Community Trademark into a national trademark if necessary, i.e., if the Community trademark is refused.
  • The duration of a Community Trademark is 10 years from the application date and it can be renewed indefinitely for the same time periods.
  • A Community Trademark is considered used through its usage in at least one of the member countries of the European Union.
